A child is a person who has not reached the age of 18 years (the age of majority) (Clause 1 of Article 54 of the RF IC).

A child - a foreign citizen or a stateless person is admitted to Russian Federation citizenship in a simplified manner if the following conditions are met (Part 6, Article 14 of Law No. 62-FZ of May 31, 2002):

1) one of the child’s parents has Russian citizenship;

2) the child’s only parent has Russian citizenship;

3) guardianship or trusteeship of a citizen of the Russian Federation has been established over the child;

4) the child is placed under supervision in a Russian organization for orphans and children without parental care.

In this case, compliance with the following requirements is not required (part 6 of article 14, part 1 of article 13 of Law No. 62-FZ):

1) continuous residence of the child on the territory of the Russian Federation on the basis of a residence permit for five years;

2) the presence of a legal source of livelihood;

3) renunciation of existing citizenship of a foreign state;

4) confirmation of Russian language proficiency.

However, if a child receives Russian citizenship on the basis that one or both of his parents are participants in the State Program for Assisting the Voluntary Resettlement of Compatriots Living Abroad in the Russian Federation, the condition of renouncing existing citizenship of a foreign state will need to be met (Part 7 of Art. 14 Law No. 62-FZ).

The procedure for admitting a child to Russian citizenship

The procedure for granting Russian citizenship to a child who is a foreign citizen or stateless person depends on the legal status of the parents and the child’s place of birth.

1. One of the parents is a citizen of the Russian Federation, or the child receives Russian citizenship at the same time as him

  • When granting citizenship of the Russian Federation to citizens who had citizenship of the USSR, lived and are living in states that were part of the USSR, but did not receive the citizenship of these states and, as a result, remain stateless, state duty is not paid. If a citizen, in an application for admission to Russian citizenship, simultaneously requests that his minor children or wards be granted Russian citizenship, the state fee is paid in the amount of 3,500 rubles. as for consideration of one application;
  • When orphans and children left without parental care are granted Russian citizenship, no state fee is paid.

Documentation requirements

In all these cases of obtaining Russian citizenship by a child, the following requirements for documents are imposed (clause 5, Regulations):

1. The application is drawn up in Russian.

2. All documents submitted along with the application that are not in Russian must be translated into Russian. The accuracy of the translation or the authenticity of the translator's signature must be certified by a notary.

3. Documents issued by the competent authority of a foreign state must be legalized or have an apostille affixed to them, if such documents are not recognized in the Russian Federation in accordance with an international treaty.

4. The authenticity of the child’s signature on the consent of a child aged 14 to 18 years to acquire Russian citizenship is certified by a notary or certified by the signature of an official and the seal of an authorized body in the presence of the child (Part 2 of Article 9 of Law No. 62-FZ).

Is it possible for a father or parents to become Russian citizens if they have a son or children who were born in Russia? The following have the right to obtain Russian citizenship:

  1. Disabled persons who have an adult capable son or daughter - citizens of the Russian Federation.
  2. Persons who have a child who is a Russian citizen, whose second parent has died or has been declared by a court decision to be missing, incompetent, of limited legal capacity, deprived of parental rights or limited in parental rights.
  3. Persons who have an adult incapacitated son or daughter, who are citizens of the Russian Federation, whose second parent has died or was declared missing, incompetent, partially capable, deprived of parental rights or limited in parental rights by a court decision.

Is it possible to obtain Russian citizenship through a child if you give birth in Russia? A child receives Russian citizenship not just by being born in a given territory. To do this, certain conditions must be met.

So, if he was born on the territory of the Russian Federation and has one of his parents who is Russian, or both of his parents are citizens of another state that did not grant the child their citizenship, or the whereabouts of his parents are not known, and of course in the case where the child has both parents who are Russian ( in this situation, the child’s place of birth does not matter), then such a child acquires Russian citizenship.

As can be seen from the above, To obtain citizenship for a child, it is not enough to give birth to him on the territory of the Russian Federation. A limited list of conditions serves as a deterrent against widespread childbearing in the Russian Federation in order to obtain Russian citizenship in a simplified manner.

Confirmation of your rights to obtain Russian citizenship for children is the following:

  • In addition to the date and place of birth, the birth certificate contains information about parents and citizenship.
  • Providing the child's birth certificate and passport, subject to the conditions described above, entitles the child to citizenship.
