1. These Rules establish the procedure for determining the average per capita income for the provision of social services free of charge in order to implement the Federal Law "On the Fundamentals of Social Services for Citizens in the Russian Federation" (hereinafter referred to as the average per capita income).

2. The calculation of the average per capita income in relation to the recipient of social services, with the exception of the persons specified in parts 1 and 3 of Article 31 of the Federal Law "On the Fundamentals of Social Services for Citizens in the Russian Federation", is made on the date of application and is carried out on the basis of documents (information) provided for the procedure for the provision of social services, approved by the authorized body of state power, on the composition of the family, the presence (absence) of income of family members or a citizen living alone and property belonging to them (him) on the right of ownership.

b) persons who are fully supported by the state.

5. When calculating the average per capita income, the following incomes received in cash are taken into account:

a) dividends and interest received from a Russian organization, as well as interest received from Russian individual entrepreneurs and (or) a foreign organization in connection with the activities of its separate subdivision in the Russian Federation;

b) insurance payments upon the occurrence of an insured event, including periodic insurance payments (rents, annuities) and (or) payments related to the participation of the insured in the investment income of the insurer, as well as redemption amounts received from a Russian organization and (or) from a foreign organization in connection with the activities of its separate subdivision in the Russian Federation;

c) income received from the use of copyright or related rights in the Russian Federation;

d) income received from the lease or other use of property located in the Russian Federation;

e) income from sales:

immovable property located in the Russian Federation;

in the Russian Federation, shares or other securities, as well as shares in the authorized capital of organizations;

in the Russian Federation, shares, other securities, stakes in the authorized capital of organizations received from participation in an investment partnership;

rights of claim against a Russian organization or a foreign organization in connection with the activities of its separate subdivision on the territory of the Russian Federation;

other property located in the Russian Federation and owned by a citizen;

f) remuneration for the performance of labor or other duties, work performed, service rendered, performance of an action in the Russian Federation. At the same time, remuneration of directors and other similar payments received by members of the management body of an organization (board of directors or other similar body) that is a tax resident of the Russian Federation, the location (management) of which is the Russian Federation, are considered as income received from sources in the Russian Federation, regardless from the place where the managerial duties assigned to these persons were actually performed or from where the said remuneration was paid;

g) pensions, allowances, scholarships and other similar payments received by a citizen in accordance with the legislation of the Russian Federation or received from a foreign organization in connection with the activities of its separate subdivision in the Russian Federation;

h) income received from the use of any means of transport, including sea, river, aircraft and motor vehicles, in connection with transportation to the Russian Federation and (or) from the Russian Federation or within it, as well as fines and other sanctions for demurrage (delay) of such vehicles at loading (unloading) points in the Russian Federation;

i) income received from the use of pipelines, power lines, fiber-optic and (or) wireless communication lines, other means of communication, including computer networks, on the territory of the Russian Federation;

j) payments to successors of deceased insured persons in cases stipulated by the legislation of the Russian Federation on compulsory pension insurance;

k) other income received by a citizen as a result of his activities in the Russian Federation;

l) compensation paid by a state body or public association for the time of performance of state or public duties;

m) monetary allowance of military personnel, employees of the internal affairs bodies of the Russian Federation, institutions and bodies of the penitentiary system, customs authorities of the Russian Federation and other law enforcement agencies, as well as additional payments of a permanent nature and food security (cash compensation instead of food rations) established by the legislation of the Russian Federation;

o) monetary compensation under a contract on the implementation of guardianship or guardianship, as well as cash payments under contracts of rent, life maintenance with a dependent.

6. Income received in foreign currency shall be recalculated into rubles at the exchange rate of the Central Bank of the Russian Federation established on the date of actual receipt of these incomes.

7. Income is taken into account before taxes and fees are deducted in accordance with the legislation of the Russian Federation.

8. The amount of wages, including compensation and incentive payments, provided for by the wage system and paid based on the results of work for the month, is taken into account in the income of the family or a citizen living alone in the month of its actual receipt, which falls on the billing period. With other established terms for the calculation and payment of wages, including compensation and incentive payments, the amount of wages received, including compensation and incentive payments, is divided by the number of months for which it was accrued, and is taken into account in the income of a family or a citizen living alone for those months that fall within the billing period.

9. The amounts of payment for seasonal, temporary and other types of work performed under fixed-term employment contracts, income received from the execution of civil law contracts, as well as income received from entrepreneurial and other activities, are divided by the number of months for which they are accrued (received), and are taken into account in the income of a family or a citizen living alone for those months that fall on the billing period.

10. The amounts of income received from the lease (lease) of real estate and other property are divided by the number of months for which they are received and are taken into account in income for those months that fall on the billing period.

11. Calculation of the average per capita income is based on the amount of income of family members or a citizen living alone for the last 12 calendar months preceding the month of filing an application for the provision of social services.

12. The average per capita income is calculated by dividing one twelfth of the income of all family members for the billing period by the number of family members.

13. The income of a citizen living alone is determined as one twelfth of the amount of his income for the billing period.
