PM. 02 "ORGANIZATIONAL SUPPORT OF THE ACTIVITIES OF THE INSTITUTIONS OF SOCIAL PROTECTION OF THE POPULATION AND BODIES OF THE PENSION FUND OF THE RUSSIAN FEDERATION"

1.1. Scope of the work program

The work program of the professional module (hereinafter referred to as the work program) is part of the main professional educational program (hereinafter BEP) in the specialty030912 Law and organization of social security(basic training)in terms of mastering the type of professional activity (VPD):professional competencies (PC):

  • Maintain databases of recipients of pensions, allowances, compensations and other social payments, as well as services and benefits up to date (PC.2.1).
  • Identify persons in need of social protection and carry out their registration using information and computer technologies (PC.2.2).
  • Organize and coordinate social work with individuals, categories of citizens and families in need of social support and protection (PC.2.3).

The work program can be used in additional professional education, advanced training, retraining and professional training of employeesin the field of social security in the presence of secondary general education.

1.2. Goals and objectives of the professional module - requirements for the results of mastering the professional module

In order to master the specified type of professional activity and the relevant professional competencies, the student in the course of mastering the professional module must:

have practical experience:

  • keeping up to date the database of recipients of pensions, allowances, compensations, services, benefits and other social payments using computer technology;
  • identification and registration of persons in need of social protection;
  • organizing and coordinating social work with individuals, families and categories of citizens in need of social support and protection using computer and telecommunication technologies;
  • advising citizens and representatives of legal entities on issues of pension provision and social protection of the population using computer and telecommunication technologies;
  • participation in the organizational and managerial work of structural subdivisions of bodies and institutions of social protection of the population, bodies of the Pension Fund of the Russian Federation;

be able to:

  • maintain up to date databases of recipients of pensions, allowances, compensations, services and other social payments using computer technology;
  • identify and register persons in need of social protection;
  • participate in the organizational and managerial work of structural subdivisions of bodies and institutions of social protection of the population, bodies of the Pension Fund of the Russian Federation;
  • interact in the process of working with executive authorities, organizations, institutions, public organizations;
  • collect and analyze information for statistical and other reporting;
  • to identify persons in need of measures of state social support and assistance from the database using computer technology;

    There are no well-formed concepts of social protection and social security in Russian legislation. Therefore, it is first necessary to determine the content of these concepts, which will allow us to correctly represent the social security system and its essence.

    The combination of the concepts of "social" and "protection" suggests that social protection is understood as a complex of various measures by which a person "defends" from the adverse effects of the outside world. Russia, as a social state, must take all possible measures to create favorable conditions for the life of its citizens, i.e. create a favorable environment. The concept of "human environment" includes:

    1) Ensuring the employment of citizens;

    2) Creation of normal working conditions;

    3) Decent wages;

    4) Providing comfortable housing;

    5) Creation of a favorable economic environment;

    6) Provision of healthy nutrition;

    7) Access to education and cultural values;

    8) Health protection;

    9) Preservation of private property;

    10) Providing citizens with social support in the event of adverse life circumstances.

    Article 7 of the Constitution tells us that the purpose of social protection is guaranteed labor protection, the health of citizens, the minimum wage (minimum wage), the support of motherhood and childhood, the disabled and the elderly, the payment of pensions and benefits, and the provision of other social guarantees.

    Implementation is a rather capacious, complex concept. It includes the entire process of emergence, formation and functioning of social security relations. The implementation of social security is understood as the procedure for applying legal, economic, organizational measures to solve the problems that social security faces.     The main legal (legal) means of implementing social security include: rule-making, law enforcement, interpretation of the norms of social security law.

    Rule-making is the main way of influencing public relations on social security. Rulemaking is the process of developing and adopting certain regulatory legal acts (NLA) on social security, for example, on pensions, benefits, social services, benefits, etc.

    The regulatory process consists of several successive stages:

    1) Legislative initiative;

    2) Organization of law enforcement in the field of social security

    Law enforcement is the solution of a specific case in a specific life situation, in other words, the “application” of the law, legal norms to specific individuals, to specific life circumstances.     4) Explanation of the content of the norm.

    Social security is the main part of the social protection of the population. The law establishes state pensions and social pensions, encourages voluntary social insurance, the creation of additional forms of social security and charity.
    Every citizen has the right to social protection. The Constitution obliges the state to create all necessary arrangements for the exercise of this right.

    The social protection management bodies and their subordinate enterprises, institutions, organizations, territorial bodies of social protection of the population form a unified state system of social protection of the population, providing state support to the family, the elderly, veterans and the disabled, persons discharged from military service, and members of their families, development of the system of social services, implementation of state policy in the field of pension provision and labor relations.

    1.2. Sources of financing social protection of the population. Non-state pension funds

    The sources of financing of social protection of the population are the state off-budget social funds: the Social Insurance Fund, the Pension Fund, the State Employment Fund, the Compulsory Medical Insurance Fund.
    The Social Insurance Fund of the Russian Federation is a specialized financial and credit institution under the Government of the Russian Federation.     Funds for social support of the population are one of the sources of financial resources for the implementation of social services for the population.

    Organization of the activities of the Department of Social Protection of the Population

    1.6. Department of Labor and Social Affairs

    The structural subdivision of the Department of Social Protection is the Department of Labor and Social Affairs, therefore this department faces the same tasks as the Department of Social Protection of the Population.
    The competence of the Department for Labor and Social Affairs includes the following areas of social protection of the population:
    a) social services;
    b) rehabilitation of the disabled;
    c) social support for the elderly, veterans and other categories of citizens;
    d) social support of the family, motherhood, fatherhood and childhood;
    e) labor and its protection.
    Organization of the activities of the Department of Labor and Social Affairs

    The pension department is a structural subdivision of the Department of Social Protection of the Population.
    The pension department of a city or district organizes its work either according to the district system, or using functional specialization.
    No matter how the work of the Pension Department is organized, appointments, payment of pensions, office work, accounting operations are carried out using computers.
    If the Pension Department organizes its work according to the precinct system, then the city or district is divided into certain sections according to the streets of the city or districts and post offices. Each section is headed by a specialist who receives citizens, accepts documents for assigning pensions, works with responsible representatives of enterprises, institutions, organizations, answers letters from citizens, etc.
    If the Pension Department builds work using functional specialization, then the city or district is not divided into sections, but specialists in the appointment and payment of pensions are divided into certain groups.     1.8. Commissions on pension issues

    1.9. Commission for the appointment of pensions

    One of the bodies involved in the provision of pensions for workers is the Commission for Assignment of Pensions. The composition of the Commission is approved by the administration of the city or district, the chairman of the Commission is the head of the district, city Pension Department, the Commission includes a representative of the district (city) financial authority, a representative of the trade union organization of enterprises, institutions, organizations of the city or district.     1.10. Medical and social expertise

    A special place in the system of management bodies of social protection of the population is occupied by institutions of the state service of medical and social expertise (MSEK). In order to implement the Federal Law "On the Social Protection of Disabled Persons in the Russian Federation", the Government of the Russian Federation adopted Resolution No. 965 of August 13, 1996 "On the Procedure for Recognizing Citizens as Disabled". This resolution approved the “Regulations on Recognizing a Person as Disabled” and “Exemplary Regulations on Institutions of State Expertise”.
    The main tasks of the institutions of the state service of medical and social expertise are to determine the group of disability, its causes (circumstances and conditions of occurrence), the timing and time of the onset of disability, the needs of a disabled person in various types of social protection.
    Institutions in their activities are guided by federal laws, decrees and orders of the President of the Russian Federation, decrees and orders of the Government of the Russian Federation, other regulatory legal acts, as well as the Regulations on Institutions.
    When determining disability, institutions are guided by the “Regulations on Recognizing a Person as a Disabled Person”, approved by the Government of the Russian Federation.
    The institutions carry out activities in cooperation with the social protection authorities, health care institutions, the employment service and other bodies and institutions operating in the field of medical and social rehabilitation of the disabled, as well as with representatives of public organizations of the disabled.
    The decision to establish disability is taken collectively by a simple vote of the specialists of the institution who conducted the medical and social examination, and is binding on the relevant state authorities, local governments, as well as organizations of all forms of ownership.
    Institutions bear responsibility for the fulfillment of the tasks assigned to them in accordance with the procedure established by the legislation of the Russian Federation. Establishments in their activities use the forms of primary accounting and reporting documents and forms of strict reporting, approved in the prescribed manner.
    The management of the institution is carried out by its head.
    The head of the institution is appointed and dismissed by the body of social protection of the population of the constituent entity of the Russian Federation, in charge of which the institution is located.

    Recognition of a person as disabled
    Recognition of a person as a disabled person is carried out during a medical and social examination, based on a comprehensive assessment of the state of his health and the degree of disability in accordance with the classifications and criteria approved by the Ministry of Labor and Social Protection of the Population of the Russian Federation and the Ministry of Health and Medical Industry of the Russian Federation.
    Depending on the degree of impairment of body functions and limitation of life activity, a person recognized as disabled is assigned I, II or III disability group, and a person under the age of 16 is assigned the category "disabled child".
    Medical and social examination of a citizen is carried out in an institution at the place of his residence or at the place of attachment to the state or municipal medical and preventive health care institution (hereinafter referred to as the health care institution).
    If, in accordance with the conclusion of a healthcare institution, a person cannot appear at the institution for health reasons, a medical and social examination can be carried out at home, in a hospital where a citizen is being treated, or in absentia on the basis of the submitted documents with his consent or with the consent of his legal representative.
    A citizen is sent for a medical and social examination by a health care institution or a body of social protection of the population.
    A person without a fixed place of residence is accepted for medical and social examination in the direction of the body of social protection of the population.
    The health care institution shall, in accordance with the established procedure, send a citizen for a medical and social examination after carrying out the necessary diagnostic, therapeutic and rehabilitation measures if there is evidence of a persistent impairment of body functions due to diseases, consequences of injuries and birth defects.
    In the direction of the health care institution, data on the state of health of a citizen are indicated, reflecting the degree of dysfunction of organs and systems, the state of the compensatory capabilities of the body, as well as the results of the rehabilitation measures taken.
    The form of referral of a healthcare institution for medical and social expertise is approved by the Ministry of Health and Medical Industry of the Russian Federation.
    The medical services necessary for conducting a medical and social examination are included in the basic program of compulsory medical insurance for citizens of the Russian Federation.
    The body of social protection of the population may send for a medical and social examination a person who has signs of disability and needs social protection, if he has medical documents confirming the violation of body functions caused by diseases, the consequences of injuries and birth defects.
    The form of sending the body of social protection of the population for medical and social expertise is approved by the Ministry of Social Protection of the Population of the Russian Federation.
    Health care institutions and bodies of social protection of the population are responsible for the accuracy and completeness of the information indicated in the referral for a medical and social examination, in the manner prescribed by the legislation of the Russian Federation.
    In the event that a health care institution or social protection authority refuses to send for a medical and social examination, a person or his legal representative has the right to apply to the bureau of medical and social examination independently if there are medical documents confirming the violation of body functions due to diseases, consequences of injuries and birth defects and associated disability.

    1.11. All-Russian Society of the Disabled

    The All-Russian Society of the Disabled (VOI) is a voluntary public organization of the disabled, operating on the basis of its own Charter, in accordance with the Constitution of the Russian Federation and current legislation throughout the Russian Federation.
    The VOI carries out its activities under the leadership of its elected bodies, regardless of political and public organizations, and is religiously neutral.
    VOI builds its work on the basis of the Program of the All-Russian Society of the Disabled.
    VOI goals:
    - protection of the rights and interests of disabled people in the Russian Federation
    - creation of conditions for disabled people that provide equal opportunities with other citizens of the Russian Federation to participate in all spheres of society;
    - integration of disabled people into society.
    VOI tasks:
    - to express and protect the legitimate interests and rights of persons with disabilities in central and local bodies of state power and administration, using the right of legislative initiative for this purpose;
    - to participate in the formation of public authorities and administration, the development of their decisions, in cases and in the manner prescribed by law;
    - assist disabled people in the implementation of the benefits and benefits established by law, in obtaining medical care, education, employment, improving their financial situation, housing and living conditions, in the implementation of spiritual needs;
    - involve disabled people in the membership of the Society, conduct a wide promotion of the activities of the VOI;
    - participate in programs conducted by other organizations and implement their own programs for the medical, vocational and social rehabilitation of disabled people;
    - interact with state and public organizations and movements acting in the interests of disabled people;

    The All-Russian Society of the Blind (VOS) is a voluntary public organization of people with visual impairments of groups I and II, created for the purpose of their social protection, operating on the basis of self-government in accordance with the Constitution and legislation of the Russian Federation.
    The EOC operates under the leadership of its elected bodies on the basis of democratic principles.
    The central, republican (republics within the Russian Federation) boards, as well as the regional, regional, Moscow city and St. Petersburg boards (hereinafter local board) of the VOS represent the Company in state, public and other organizations.

    Sign 2: in accordance with this sign, social security is that it is carried out at the expense of various financial sources.

    The main financial source is the state budget. The second most important source is off-budget state funds. 3rd are the budgets of the constituent entities of the Russian Federation (Russian Federation) and municipal budgets.

    Sources of receipt of funds in the federal, regional and municipal budgets - taxes and fees.

    Sources of funds for off-budget insurance funds are insurance premiums and subsidies from the budget.

    Funds from federal budgets, budgets of subjects and municipal budgets are spent on social security:

    1) Citizens performing important state functions (military personnel, law enforcement officers, civil servants);

    2) Citizens who have merits before the state or suffered through the fault of the state (participants and veterans of the Second World War (Great Patriotic War), blockade survivors, awarded orders and medals, Chernobyl victims, etc.);

    3) Disabled citizens and families (children, orphans, disabled people, low-income, large and foster families).

    Funds from off-budget insurance funds are spent depending on the specialization of the fund. These funds are: Pension Fund (PF, PFR, RF PF, Pension Fund of the Russian Federation), Social Insurance Fund (FSS), Compulsory Medical Insurance Fund (FOMS).

    Funds from these funds are directed to:

    – Pension Fund (PF) – payment of pensions;

    – Allowance for the burial of deceased pensioners;

    Social Insurance Fund (FSS) - for benefits, sanatorium treatment, keeping children in health camps;

    Compulsory Medical Insurance Fund (FOMS) - for the provision of free medical care and treatment.

    3 sign; special subject composition, i.e. circle of persons to be protected. It includes: children, women, pensioners, the disabled, the unemployed, large families, foster families.

    4 sign: its warranty. It means that the state legislatively, organizationally and economically provides all types of social security with the necessary funds.

    Sign 5: in accordance with this sign, various types of social security (social security) are provided only upon the occurrence of the relevant circumstances specified in the law.

    6 sign: the purpose of its provision. The main goal of each type of social security (social security) is to equalize the social status of certain categories of citizens with the rest of society.

    3) Public relations related to social security

    The totality (listed in clause 2 of Theme No. 1) of signs indicates the existence of several groups of social relations related to social security, which have their own characteristics.

    The 1st group of features is the relationship for the direct provision of appropriate types of social security to citizens at the expense of special funds allocated for these purposes. In the course of the functioning of these relations, the realization of the rights of citizens to pensions, benefits, compensation payments, social services, medical care, benefits, social assistance takes place. The legal norms governing relations for the provision of the listed types of social security in the aggregate constitute the social security law (PSL).
