Academic leave is a break in the educational process for a certain time, which is provided to students for various reasons. The student is entitled to such a break, paragraph 12 of Art. 34 of the Law on Education. The rules according to which leave is issued and granted are established by order of the Ministry of Education and Science dated June 13, 2013 No. 455.

Who can take academic leave?

It is allowed to take a break in the educational process for a while for students who are studying full-time under the program of secondary vocational or higher education. In other words, students of universities, colleges and technical schools.

Reasons for granting an academic leave to a student

Just to make a temporary break in training will not work, the reasons for this must be very serious. Each reason will need to be confirmed by relevant documents, otherwise the head of the educational institution will have the right to refuse to provide it. Academic leave is granted to the student on the grounds discussed below.

For medical reasons

The reason for which the student needs a break in training, in this case, is some kind of illness that does not allow mastering the training program at the moment. It will be necessary to issue a certificate from the medical institution with the signature of the head physician confirming the severity of the disease.

For family reasons

Such circumstances are considered to be leave to care for a child or a close seriously ill relative. According to family law, close relatives are considered parents, brothers and sisters, grandparents. In this case, certificates confirming a serious illness will also be required.

Another circumstance that may require a temporary suspension of education may be a difficult financial situation in the student's family.

How to take academic leave at the university?

To apply for a vacation, write an application addressed to the head of the educational institution. It should indicate in connection with what circumstances the student needs leave, for how long, list the documents that can confirm its need. Based on the application, an order is issued to grant leave.

It is allowed to leave the vacation before the end of its term, if the student writes an application for early retirement. If the term ends, and the student does not start studying for two months without good reason, he can be expelled from the educational institution for absenteeism.

Required package of documents

Depending on the situation in which the student needs leave, the following documents are attached to the application:

  • a medical certificate from a medical institution if studies are interrupted due to illness;
  • a summons from the military registration and enlistment office, which indicates the time and place of sending for military service (in case of conscription into the army);
  • medical certificates about the illness of a relative when taking leave to care for him;
  • birth certificate of the child, if the reason is child care;
  • certificates of the salary of parents and from social security authorities on the recognition of the family as low-income, if the reason for the interruption in education is a difficult financial situation.

Advice: in case of pregnancy, it is necessary to issue maternity leave, and not academic leave. On the basis of the Regulation on the payment of benefits to citizens with children, which was approved by Resolution No. 883, full-time students of secondary and higher educational institutions are entitled to receive benefits for pregnancy and childbirth. The educational institution pays it from the funds of the Social Insurance Fund. But if an academic leave is issued, there are no grounds for paying benefits. Therefore, if pregnancy occurs during an academic leave, it must be interrupted and maternity leave taken.

Terms of granting academic leave at the university

In accordance with clause 2 of the Procedure, a break in training can be taken for a period not exceeding 2 years.

When can a grant be denied?

Financial issue

Being a student on academic leave is not grounds for termination social stipend payments. The payment of an academic scholarship is suspended from the first day of the month following the month in which the academic leave was granted.

It is worth paying special attention to the fact that if a student is studying on a paid basis (i.e., under an education agreement at the expense of an individual and (or) legal entity), then during academic leave tuition fee is not charged to him.

In most universities, funds previously paid as tuition fees are not returned, but are credited towards future periods of study. At the same time, if there was an increase in the cost of education while the student was on academic leave, then, most likely, the difference will have to be paid after leaving the vacation. More accurate information about this can be found in the charter of the educational institution, its internal regulations or in the contract for education on a paid basis.

Students who are on academic leave for medical reasons are assigned and paid monthly compensation payments. In accordance with Decree of the Government of the Russian Federation of November 3, 1994 N 1206 “On approval of the procedure for the appointment and payment of monthly compensation payments to certain categories of citizens”, such payments amount to 50 rubles per month.

The decision to assign such payments is made by the head of the relevant educational institution. It must be received within 10 days from the date of receipt of all documents from the student.

If the application for payments followed no later than 6 months from the date of granting the leave, then they are assigned from the first day of granting the academic leave. Otherwise, payments are assigned and paid for the elapsed time, but not more than 6 months from the day of the month in which the application for the appointment of these payments was submitted. These payments are made at the expense of educational institutions allocated to pay scholarships to students.

For students in areas and localities where district coefficients to wages, the amount of monthly compensation payments is determined using these coefficients, regardless of the place of actual residence of the recipient during the period of academic leave for medical reasons.

Termination of academic leave

Academic leave can be terminated early. The basis for this is a written statement of the student. He is allowed to study after the issuance of an appropriate order by the head of the educational organization or an official authorized by him.

The basis for issuing an order by the rector of an educational institution to withdraw a student from academic leave is his personal statement and the conclusion of the medical commission on the possibility of continuing education (if the leave was taken for medical reasons).

If necessary, the student can extend academic leave. To do this, he must provide the same package of documents as when receiving a vacation.

Please note that if a student has not submitted an application for leave to an educational institution, then this may be interpreted by his leadership as absence from vacation, and this, in turn, entails the expulsion of the student from the educational institution. Absence of the teacher from vacation must be recorded by the relevant act.

What is academic leave

This is a deferment of studies provided to a student or graduate student due to the occurrence of circumstances that temporarily prevent the continuation of full-fledged studies. Grounds for academic leave at the university

List of valid reasons for academic leave:

  • pregnancy and caring for a child up to 3 years. In this case, applications are drawn up in the same step-by-step manner as when leaving the place of work on maternity leave:
    • Maternity leave (the so-called maternity leave) lasts 140 days; in the case of multiple pregnancy or complications during childbirth, this period is increased;
    • after the expiration of the initial period, an application is written for granting leave to care for a child (children) up to 1.5 years;
    • if necessary, parental leave is issued until the child reaches 3 years of age;
  • state of health - exacerbation of chronic or the emergence of new diseases requiring long-term treatment, serious injuries;
  • call for military service;
  • difficult family circumstances, such as caring for seriously ill loved ones or a sharp drop in financial condition;
  • receiving education in another educational institution.

For sufficiently weighty medical reasons, the university does not have the right to refuse the student permission to interrupt the studies. In other cases, the decision remains with the administration of the educational institution and may be negative.

How to apply for an academic leave at a university, institute, college

Sometimes students get lost because they do not know what certificate is needed for academic leave. The procedure for granting the academy is the same for secondary and higher educational institutions.

  1. Pay off all debts, if any.
  2. Collect a package of documents confirming the need for a break in study.
  3. Write a statement addressed to the rector with justification of the reasons.
  4. Bring documents, medical certificates and an application to the dean's office.
  5. Wait for the application to be considered.
  6. If cash payments are due, apply for them separately.

A sample application for an academic leave, as a rule, can be obtained from the academic department or from the secretary of the dean's office.

If all the points are completed correctly and without delay, the whole procedure will take no more than 2-3 weeks. In accordance with the law, the consideration of the request is made no longer than 10 days from the date of its receipt.

An academic certificate with a list of subjects taken when applying for leave for interruption of studies is not issued. This document is issued only upon deduction.

Timing and quantity

The legislation does not set a limit on the number of academic leave, but there are still some restrictions:

  • it cannot last more than two years (an exception is a decree, special rules apply here);

Army

What laws regulate the procedure for granting academic leave?

Academic leave is granted on the basis of clause 12, part 1, art. 34 of the Federal Law of December 29, 2012 No. 273-FZ "On Education in the Russian Federation", which entered into force on September 1, 2013. This is a basic legislative act that establishes the right of students to receive academic leave.

The specific provisions for the provision of the academy are established by a by-law - Order of the Ministry of Education and Science of Russia dated June 13, 2013 No. 455 "On approval of the procedure and grounds for granting academic leave to students".

The Order has an Appendix - "The procedure and grounds for granting academic leave to students" . This is the main document that determines the solution of most issues related to the academy.

But to solve some particular issues, it is necessary to turn to other sources. Thus, the issues of granting maternity leave, as well as parental leave until the child reaches the age of three, are closely related to obtaining an academy due to pregnancy. This issue is not disclosed in the Order of the Ministry of Education and Science of Russia dated June 13, 2013 No. 455, therefore it is resolved on the basis of the already mentioned Federal Law “On Education”.

Issues related to the deferral of military conscription for the period of academic leave are regulated by Art. 24 of the law "On military duty and military service".

Issues related to the payment of scholarships are regulated by Order of the Ministry of Education and Science of the Russian Federation dated August 28, 2013 No. 1000.

How to take academic leave?

The algorithm for obtaining an academy is as follows:

  1. You collect documents confirming valid circumstances for which you have to interrupt your studies.
  2. Write an application addressed to the rector of the educational institution.
  3. Attach supporting documents to your application.
  4. Submit an application with documents to the administration.

What documents are required to apply for an academic leave?

To apply for academic leave, you must provide documents along with the application proving that the student cannot attend classes. Depending on the circumstances, these may be:

— medical certificates 027/U and 095/U;
- a summons from the military registration and enlistment office;
- other documents (for example, confirming the illness of a relative, an invitation to study abroad, etc.).

On what grounds can academic leave be granted?

The application for academic leave must indicate on what basis the student is asking for a break in studies. The circumstances on the basis of which academic leave is granted can be divided into conditional and unconditional.

Unconditional conditions include:

– medical indications preventing the continuation of education and confirmed by the conclusion of the medical commission (including pregnancy);
- Service in the army by conscription.

Conditional are:

- family circumstances;
- other circumstances.

Here, the leadership of the educational institution decides how valid the reasons are that encourage the student to interrupt their studies.

Student, remember: problems with passing a session are not a justification for an academy! If you "scored" on your studies, take care of very convincing, preferably - unconditional justifications for obtaining an academic leave. The rector’s office will definitely find out how you study, and if they suspect you are trying to avoid a well-deserved expulsion, they may ignore family and especially “other” reasons for your application.

Do I need to somehow confirm the justifications indicated in the application for academic leave?

Necessarily. The rector's office will not take your word for it, even if you bring an application on crutches or show clear signs of the ninth month of pregnancy. Please note that even in the case of unconditional medical indications, certificates must be drawn up according to the rules (forms 027/U and 095/U).

As they say, "without a piece of paper you are an insect." It is impossible to fight the university bureaucracy, you have to play by its rules.

Where can I download a sample application for academic leave?

An application for an academic leave is written according to the usual standard. It is indicated:

- position and full name of the head of the educational institution;
- data about the applicant (including information about the faculty, specialty, group);
- the word "Statement" is placed in the center;
- a new line sets out a request for an academic leave;
- the rationale for its provision is indicated with a list of the attached documents;
- put the date of the application;
- the signature of the applicant completes the document.

What is the duration of academic leave?

The maximum duration of the academy is two years. Most often, a student is given a year. If the problems that led to the interruption of studies have not disappeared, you can take another academic leave.

How many times can you take academic leave?

You can take the Academy as many times as you want (but subject to the provision of strong justifications). The law does not limit the student in the number of academic holidays.

Can academic leave be extended?

Strictly speaking, academic leave is not extended; if necessary, a new one is simply taken. But in colloquial speech and even in legal advice, they often talk about extending academic leave, so this expression can also be used.

There are only four important things to remember:

– if necessary, an extension is written a new application for the grant of academic leave;
- Documents are again attached to the application, confirming the presence of valid circumstances forcing the student to interrupt training (that is, the whole procedure is repeated);
- a budget place is guaranteed to be saved only at the first academy;
— the deferment from conscription applies only to the first academic leave.

Who makes the decision to grant academic leave?

This decision is made by the head of the educational institution (usually the rector). A decision may also be made by an authorized official. In any case, the legislation has 10 days from the date of receipt of the application for academic leave to make a decision.

Can academic leave be denied?

The management of the educational institution has the right to refuse the applicant if it considers the circumstances that prompted him to take a break from training insufficiently convincing.

How to take academic leave for medical reasons?

It is quite easy to get academic sick leave, since medical indications are considered the most objective reasons for a break in studies. But not every illness can justify the need for an academy. The decision on whether the student can continue studying or if he needs a break to restore health is made by the medical commission.

Documents required to consider this issue:

1) certificate of temporary disability (form 095/U);
2) an extract from the medical history (form 027/U).

With these documents, you should contact the leadership of the educational institution, which will give a direction for passing a medical examination. Usually the commission is held in a student clinic. If the medical expert commission recognizes the need for a break in the educational process, the university provides the student with an academy.

Do they provide academic leave for non-medical reasons?

Yes, there is such a possibility. Academy can be obtained:

- in case of desire to serve in the army on conscription;
- under family circumstances forcing the student to postpone the continuation of education;
- in other cases, when objective reasons prevent the continuation of education.

The concept of "other circumstances" is very broad, but it should be borne in mind that the university may consider them insufficient for granting academic leave. For example, an invitation to work or study abroad can be regarded as both a valid and disrespectful reason, depending on the position of the administration. It happens that students are even provided with an academy so that they can participate in a television show. But this is the good will of the leadership of the educational institution, and not a rule.

We also note that it is easier for students who study well to get academics for other reasons. If a student has problems with studies, the administration may consider an application for an academician an attempt to evade the session.

Can I take maternity leave?

Pregnancy is a medical condition and is an unconditional circumstance justifying the receipt of academic leave. To go on academic leave for pregnancy, you must:

- get a certificate in the form 095 / U and an extract from the outpatient card of the antenatal clinic on registration due to pregnancy;
- apply with these documents to the dean's office or administration of the educational institution;
- get a referral to undergo a medical expert commission (usually it is carried out on the basis of a student clinic);
- pass the commission;
- Attach the decision of the commission to the application for academic leave.

Is it possible to extend academic leave in order to raise a child up to three years?

In the Order of the Ministry of Education and Science of Russia dated June 13, 2013 No. 455 “On approval of the procedure and grounds for granting academic leave to students”, there are no special instructions on providing an academy for the purpose of raising a child. But paragraph 12 of part 1 of Art. 34 of the Federal Law of December 29, 2012 No. 273-FZ "On Education in the Russian Federation" provides for the observance of the rights of a woman regarding receiving leave to care for a child up to three years (in accordance with the general provisions of the current legislation).

How to extend academic leave in practice? The algorithm is simple:

1) get the first academy for pregnancy (for two years);
2) after the expiration of the first academic year, apply for the second one - already for family reasons (for another two years).

Do they give academic leave for family reasons?

Yes, this is a fairly common reason for getting an academy. For example, the justification may be the need to raise a child, care for a seriously ill relative, and even a difficult financial situation in the family. All these and other family circumstances must be documented.

But keep in mind that the management of the educational institution has the right to refuse a student. When making a decision, the current circumstances in the student's life are taken into account, the objectivity of the reasons for interrupting education is analyzed. The decision in each case is made individually: one student can be given an academic, and another, under the same circumstances, denied. For example, the suspicion that the student is only trying to solve problems with the session can lead to rejection.

Sometimes the university offers an alternative solution to the issue: for example, in a difficult financial situation that forces a student to work, he may be advised to transfer to a correspondence department.

Is there an academic leave for military service?

It would seem, why would a full-time student take an academy for conscription service? If you graduate from high school or be expelled, then you will serve. However, in a number of cases, students choose to take a break from the educational process and serve in the army - usually for the purpose of further careers. In this case, you can take the academician on the basis of a summons from the military registration and enlistment office, and then return to the university.

Is it possible to take academic leave in the first year?

You can take academy at any stage of your studies. The legislation does not place restrictions on this issue, since health problems or other circumstances that impede learning can arise at any time.

It should only be remembered that the university administration treats students taking academic leave in the 1st year with special attention and carefully analyzes the rationale for the application. Given that before, you can understand the administration! So do not hope that the academy will save you with poor study.

Is it possible to take academic leave in the fifth year?

Yes, you can take academic leave in the 5th year. Are scholarships paid during academic leave?

According to paragraphs. 13 - 14 of this Order, the grounds for terminating the payment of a scholarship (both state academic and social) are:

- expulsion from an educational institution;
- academic debt;
- receiving a "satisfactory" rating during the session.

Academic leave is not among the reasons why the payment of a scholarship is terminated. In itself, being in the academy does not constitute an academic debt. So if you received only "good" and "excellent" in all subjects in the process of passing the previous session, and now you have taken an academic, the scholarship will be paid.

Are any monetary compensations paid during academic leave?

A student who has received an academic on the basis of medical indications receives additional cash payments in accordance with a special by-law - the Government Decree "On approval of the procedure for assigning and paying monthly compensation payments to certain categories of citizens". True, cash payments during academic leave are small - only 50 rubles a month.

To receive compensation payments, it is necessary to submit an application with the relevant documents to the administration (you can indicate this moment in the application for academic leave). Compensation begins to be paid from the day the academician is granted, if the application for it was received no later than 6 months from the date the vacation was granted. If the student caught himself after six months, payments will be received no more than 6 months from the day of the month in which the application for compensation was submitted.

Students who are on parental leave until they reach the age of three receive a monthly allowance in accordance with the Federal Law of May 19, 1995 No. 81-ФЗ “On State Benefits for Citizens with Children” (with subsequent amendments and additions).
