Academic leave is a break in the educational process for a certain time, which is provided to students for various reasons. The student is entitled to such a break, paragraph 12 of Art. 34 of the Law on Education. How to take academic leave at the university?

To apply for a vacation, write an application addressed to the head of the educational institution.   • a medical certificate from a medical institution if studies are interrupted due to illness;

  • birth certificate of the child, if the reason is child care;

Advice: in case of pregnancy, it is necessary to issue maternity leave, and not academic leave. On the basis of the Regulation on the payment of benefits to citizens with children, which was approved by Resolution No. 883, full-time students of secondary and higher educational institutions are entitled to receive benefits for pregnancy and childbirth. The educational institution pays it from the funds of the Social Insurance Fund. But if an academic leave is issued, there are no grounds for paying benefits. Financial issue

Being a student on academic leave is not grounds for termination social stipend payments. The payment of an academic scholarship is suspended from the first day of the month following the month in which the academic leave was granted.

It is worth paying special attention to the fact that if a student is studying on a paid basis (i.e., under an education agreement at the expense of an individual and (or) legal entity), then during academic leave tuition fee is not charged to him.

In most universities, funds previously paid as tuition fees are not returned, but are credited towards future periods of study. At the same time, if there was an increase in the cost of education while the student was on academic leave, then, most likely, the difference will have to be paid after leaving the vacation. Students who are on academic leave for medical reasons are assigned and paid monthly compensation payments. In accordance with Decree of the Government of the Russian Federation of November 3, 1994 N 1206 “On approval of the procedure for the appointment and payment of monthly compensation payments to certain categories of citizens”, such payments amount to 50 rubles per month.

The decision to assign such payments is made by the head of the relevant educational institution. It must be received within 10 days from the date of receipt of all documents from the student.

If the application for payments followed no later than 6 months from the date of granting the leave, then they are assigned from the first day of granting the academic leave. Otherwise, payments are assigned and paid for the elapsed time, but not more than 6 months from the day of the month in which the application for the appointment of these payments was submitted. These payments are made at the expense of educational institutions allocated to pay scholarships to students.

Termination of academic leave

  • call for military service;

For sufficiently weighty medical reasons, the university does not have the right to refuse the student permission to interrupt the studies. In other cases, the decision remains with the administration of the educational institution and may be negative.

How to apply for an academic leave at a university, institute, college

Sometimes students get lost because they do not know what certificate is needed for academic leave. The procedure for granting the academy is the same for secondary and higher educational institutions.

  1. Pay off all debts, if any.
  2. Collect a package of documents confirming the need for a break in study.
  3. Write a statement addressed to the rector with justification of the reasons.

What laws regulate the procedure for granting academic leave?

Academic leave is granted on the basis of clause 12, part 1, art. 34 of the Federal Law of December 29, 2012 No. 273-FZ "On Education in the Russian Federation", which entered into force on September 1, 2013. This is a basic legislative act that establishes the right of students to receive academic leave.

The specific provisions for the provision of the academy are established by a by-law - Order of the Ministry of Education and Science of Russia dated June 13, 2013 No. 455 "On approval of the procedure and grounds for granting academic leave to students".

The Order has an Appendix - "The procedure and grounds for granting academic leave to students" . This is the main document that determines the solution of most issues related to the academy.

But to solve some particular issues, it is necessary to turn to other sources. Issues related to the deferral of military conscription for the period of academic leave are regulated by Art. 24 of the law "On military duty and military service".

Issues related to the payment of scholarships are regulated by Order of the Ministry of Education and Science of the Russian Federation dated August 28, 2013 No. 1000.

How to take academic leave?

The algorithm for obtaining an academy is as follows:

  1. You collect documents confirming valid circumstances for which you have to interrupt your studies.
  2. Write an application addressed to the rector of the educational institution.

Student, remember: problems with passing a session are not a justification for an academy! Do I need to somehow confirm the justifications indicated in the application for academic leave?

Necessarily. The rector's office will not take your word for it, even if you bring an application on crutches or show clear signs of the ninth month of pregnancy. Please note that even in the case of unconditional medical indications, certificates must be drawn up according to the rules (forms 027/U and 095/U).

Where can I download a sample application for academic leave?

An application for an academic leave is written according to the usual standard. It is indicated:

- position and full name of the head of the educational institution;

What is the duration of academic leave?

The maximum duration of the academy is two years. Most often, a student is given a year. If the problems that led to the interruption of studies have not disappeared, you can take another academic leave.

How many times can you take academic leave?

You can take the Academy as many times as you want (but subject to the provision of strong justifications). The law does not limit the student in the number of academic holidays.

Can academic leave be extended?

Strictly speaking, academic leave is not extended; if necessary, a new one is simply taken. But in colloquial speech and even in legal advice, they often talk about extending academic leave, so this expression can also be used.

There are only four important things to remember:

– if necessary, an extension is written a new application for the grant of academic leave;

How to take academic leave for medical reasons?

Do they provide academic leave for non-medical reasons?

Yes, there is such a possibility. Academy can be obtained:

- in case of desire to serve in the army on conscription;
- under family circumstances forcing the student to postpone the continuation of education;
- in other cases, when objective reasons prevent the continuation of education.

The concept of "other circumstances" is very broad, but it should be borne in mind that the university may consider them insufficient for granting academic leave. For example, an invitation to work or study abroad can be regarded as both a valid and disrespectful reason, depending on the position of the administration. It happens that students are even provided with an academy so that they can participate in a television show. But this is the good will of the leadership of the educational institution, and not a rule.

Can I take maternity leave?

Pregnancy is a medical condition and is an unconditional circumstance justifying the receipt of academic leave. To go on academic leave for pregnancy, you must:

- get a certificate in the form 095 / U and an extract from the outpatient card of the antenatal clinic on registration due to pregnancy;
- apply with these documents to the dean's office or administration of the educational institution;

Is it possible to extend academic leave in order to raise a child up to three years?

In the Order of the Ministry of Education and Science of Russia dated June 13, 2013 No. 455 “On approval of the procedure and grounds for granting academic leave to students”, there are no special instructions on providing an academy for the purpose of raising a child. How to extend academic leave in practice? The algorithm is simple:

But keep in mind that the management of the educational institution has the right to refuse a student. The decision in each case is made individually: one student can be given an academic, and another, under the same circumstances, denied. Is there an academic leave for military service?

It would seem, why would a full-time student take an academy for conscription service? If you graduate from high school or be expelled, then you will serve. However, in a number of cases, students choose to take a break from the educational process and serve in the army - usually for the purpose of further careers. Is it possible to take academic leave in the first year?

Are scholarships paid during academic leave?

According to paragraphs. 13 - 14 of this Order, the grounds for terminating the payment of a scholarship (both state academic and social) are:

- expulsion from an educational institution;
- academic debt;
- receiving a "satisfactory" rating during the session.

Academic leave is not among the reasons why the payment of a scholarship is terminated. In itself, being in the academy does not constitute an academic debt. So if you received only "good" and "excellent" in all subjects in the process of passing the previous session, and now you have taken an academic, the scholarship will be paid.

Are any monetary compensations paid during academic leave?

A student who has received an academic on the basis of medical indications receives additional cash payments in accordance with a special by-law - the Government Decree "On approval of the procedure for assigning and paying monthly compensation payments to certain categories of citizens". True, cash payments during academic leave are small - only 50 rubles a month.

To receive compensation payments, it is necessary to submit an application with the relevant documents to the administration (you can indicate this moment in the application for academic leave). Compensation begins to be paid from the day the academician is granted, if the application for it was received no later than 6 months from the date the vacation was granted. If the student caught himself after six months, payments will be received no more than 6 months from the day of the month in which the application for compensation was submitted.

Students who are on parental leave until they reach the age of three receive a monthly allowance in accordance with the Federal Law of May 19, 1995 No. 81-ФЗ “On State Benefits for Citizens with Children” (with subsequent amendments and additions).
