In 2009, bankruptcy proceedings were launched against the company, thanks to which the Moscow Region managed to return part of the stolen property and funds. As part of the bankruptcy case, MOITK received funds that were proportionally distributed among creditors, and the budget of the Moscow Region received 63.4 million rubles, the press service specified.

“The Ministry of Foreign Affairs is actively working to return the stolen property. From December 2009 to the present, as a result of the measures taken, funds and property have been returned to the budget of the Moscow Region for a total amount of more than 9.7 billion rubles. There is a lot of information about what will happen, what will not happen, what summer residents should do, what they should not do, what flies over their dachas, what does not fly there, what needs to be registered, what does not need to be registered. Please, you have the floor: what is really going on?

Andrey Averkiev: I will try to give objective information about what is happening today in the Moscow region, what our colleagues in the municipalities are doing under our organizational authority - the Ministry of Property Relations. Our main task is not fences, not baths, not greenhouses. We started this work in May-June 2016, when we saw that quite serious objects, namely houses, real houses with an area of ​​​​several hundred square meters, sometimes thousands of square meters, entire palaces are not registered in the cadastral register, rights are not registered for them property, respectively, such objects are not subject to taxation. We calculated how much could be in the area. Of course, this is a forecast figure, but it still amazed us. We passed through several settlements, several villages and saw that about 30% of the objects are not registered in the cadastre, are not registered, and therefore are not subject to taxation. And by an elementary mathematical calculation, they came to the conclusion that there could be about half a million of such objects in the area. We understand that the system of registration of rights, the system of cadastral registration is quite complicated according to our legislation, but still this is not a reason not to register objects and, in fact, to evade tax. Some of our residents, of course, are afraid of this complicated procedure, and some, for sure, deliberately do not put their objects on the cadastral register and, in fact, evade taxation. And when we saw this, we set ourselves a simple task to identify such objects, and here we used the information resources that were created in the Moscow region. It is clear that no quadrocopters fly.

Andrey Averkiev : Let me explain. Aerial photography of the entire territory of the Moscow region was carried out in 2014. It was a state order, a state purchase, when a professional organization flew around the entire Moscow region on an airplane with special cameras. This survey was stitched and superimposed on a cartographic resource, that is, we received a map of the Moscow region, but not in the form of all known symbols, but in the form of a real photographic image. Moreover, this image is high-quality, highly detailed, and from this aerial photograph you can see everything down to the car and some small forms. No one is flying over the area now, this aerial photo is from 2014. This aerial photograph was overlaid with real estate cadastre data, received information from Rosreestr on registered rights, received information from the tax service on which real estate objects are taxed. And when we combined all these information sources, we saw that, indeed, a rather serious number of buildings, moreover, serious buildings, not fences or wells, are really missing in the cadastre and tax inspection data. It is these objects that we have identified, and right now we have the third stage - to identify the owners of such houses, and we understand, I repeat, it is important that aerial photography was carried out in 2014, and today we have 2017, more than two years have passed , and it is obvious that on the tours that we conduct together with colleagues from municipalities, we see that these houses are actually used, people live in them, they are connected to electricity, they pay for gas, they see electricity there, and we understand that houses are really subject to taxation, these are operating, residential facilities. And we predict that there are about 500 thousand such objects, and their owners are the object of our search, and our task is to remind each of these owners that it is necessary to protect, including their property rights to those objects in which they live, to register them, and, accordingly, as a logical consequence, it is to become a payer of property tax for individuals, like all other citizens of the country. That is the essence of our actions. It is clear that other related objects may be located on the land plots. We know that there is a big house, a main house. A guest house can be built on the land plot, a garage for several cars with utility rooms, a bathhouse, bathhouses are also not 5x6 log cabins, but objects that are quite serious in terms of area - these are all capital construction projects, this is all that is also subject to registration of rights and taxation. Therefore, our emphasis on these objects is capital objects, not fences.

When they wrote about everything about this, they referred to the government of the Moscow region, and, as everyone understood, it was about aerial photography, and they thought that now drones are flying to reveal all this.

And the fact that a lot could have changed since 2014, has something else been built?

Andrey Averkiev: It could, but this is the next stage in our work. We are going consistently, in stages, that during this time new houses have appeared, we understand that construction is underway, summer cottages are growing, and someone does not register the rights to newly built objects, but I repeat, step by step, let's go sequentially, First, let's deal with those objects that were built before 2014.

But people are still worried. Because I understand your desire to take taxes from luxurious palaces, but summer residents are worried that their summer houses, any capital construction projects that are located on the plots will fall under taxes.

Andrey Averkiev: We are sane people, and it is clear why waste time and effort on those objects that, in principle, are not subject to taxation, such as gazebos. And another important point: many people forget about it and do not know it, the fact is that, in accordance with tax legislation, the Tax Code, objects with an area of ​​​​less than 50 square meters are not subject to taxation at all. This is a tax deduction. Relatively speaking, you have a house of 100 square meters, the tax deduction is 50, 100 minus 50, and only an area equal to 50 square meters will be subject to property tax. If your house is less than 50 square meters, some kind of garden house is 30 squares 5x6, then it is not subject to taxation.

Nevertheless, we are already told stories that people - there is no law yet - and some notifications are already coming from the tax office about specifically such small buildings.

Andrey Averkiev : While doing this work, it is clear that the logical conclusion, when we identified an unregistered house using aerial photography, as a result of a detour on the ground, made sure that it exists, that it is residential, that they live there, which means that the next step is a notification from the district tax inspectorate to the owner of such a house, which, as a rule, we hand over against receipt, that “dear resident of the Moscow region, we saw that you are the owner of such a building, that your building is not registered, that you do not pay tax, as expected kindly do so-and-so.” This is about the logical conclusion of this work. And then we hope that, as a rule, people respond, all the more so, we help, give a clear algorithm of actions, simplify life, try to reduce labor costs, involve our subordinate enterprise - the Moscow Regional BTI - for cadastral registration of such objects and provide all kinds advisory assistance. We have many employees whose phone numbers are listed in such notices, so we receive calls from residents, and we advise on how to proceed. As for the tax notices that people already receive, these notices are received as usual. Here I do not rule out errors, because anyway, it must be admitted, there are individual errors in the databases of the tax service and in the State Real Estate Cadastre. We have more than 8 million real estate objects in the region - these are apartments and rooms, and, unfortunately, there are mistakes that even such ridiculous examples entail, although people who receive tax notices are definitely not laughing, but we have come across this, it is clear that a certain number of times, when, for example, the area of ​​\u200b\u200ba apartment in a residential building is taken into account as the area of ​​\u200b\u200bthe entire residential building, and the tax service automatically calculates the tax for a one-room apartment not for 40 square meters, relatively speaking, and for several thousand square meters, and a citizen, the owner receives a tax of several hundred thousand rubles. This is an obvious mistake. It is clear that it is correctable, this is a technical error, an error in the State Real Estate Cadastre. There is no need to be afraid, here we explain to people that they just need to either report to the Ministry of Property Relations to our mail, or through the Dobrodel portal, you can report such an error, and in an indisputable manner, out of court, we correct such errors. There is no need to be afraid, this is all within the margin of error.

People come to the Regpalata and ask if it is necessary to register? They are told: if you want - register, if you want - no, but if you register, you will pay tax. What should they do?

Andrey Averkiev A: Here really at will. If there is a desire to register such a house with an area of ​​16 square meters as a property, then you have the right to do so. But this object will not be subject to taxation, because there is a tax deduction - 50 square meters.

That is, neither a simple tax nor a triple tax will be levied on him?

Andrey Averkiev A: No tax will be charged on it. I wanted to dwell a little more on another error that is being replicated. It's a triple tax. We are talking about something else, not about the triple tax on the house, about the property tax, because it is impossible to take any tax there, because this house is not available as an object of taxation. After all, the initiative is different, the initiative of the Federal Tax Service, the Ministry of Finance of the Russian Federation to make an increased land tax on a land plot. Because let's imagine such an example: you are the owner of a land plot and decided to build a country house on the plot. It is clear that if you were not the owner, then you would not even build a house, because the risks are great, this is completely unauthorized construction, and you can lose money. But if you are the owner, then you understand that the house that you have built may not be registered and you may not pay tax on it. This is the same situation that I just described in detail. And we are talking about the fact that since we cannot take property tax on an unregistered house, then the logic is as follows: we identify such a house, identify the owner of the land plot that built such a house, and say: since you have not registered the house, the tax on the house If you do not pay, be kind enough to pay with a certain multiplier, for example, three, a tax on a land plot. We pay two taxes: land tax on a land plot, property tax on a house on a land plot. So that's exactly what we're talking about.
